Terms and Conditions
1. Scope
This is a courtesy translation. The German version of this document is legally binding and shall prevail in the event of any discrepancy.
These General Terms and Conditions (T&Cs) apply to all orders placed via the online shop GastroAir Shop (operated by GastroAir GmbH, Lahnstraße 31-33, 45478 Mülheim an der Ruhr, Germany, info(at)gastroair.de).
GastroAir addresses this shop to businesses within the meaning of § 14 BGB. Should a contract nevertheless exceptionally be concluded with a private individual, the mandatory statutory consumer protection provisions, in particular the statutory right of withdrawal pursuant to Clause 6, remain unaffected.
2. Conclusion of Contract
2.1 The presentation of goods in the shop does not constitute a legally binding offer, but a non-binding invitation to order.
2.2 By clicking the "Submit order" button, the customer submits a binding order for the goods contained in the shopping cart.
2.3 Confirmation of receipt of the order is sent immediately by email but does not yet constitute acceptance of the contract. The contract is only concluded once GastroAir GmbH issues an explicit declaration of acceptance, either by way of a shipping confirmation by email or by dispatch of the goods.
3. Prices and Shipping Costs
3.1 All prices in the shop are stated in euros and are exclusive of the applicable statutory VAT plus shipping costs.
3.2 Shipping costs are shown separately during the ordering process.
4. Payment Terms
4.1 Payment can be made using any payment method offered in the shop.
4.2 The goods remain the property of GastroAir GmbH until paid in full.
5. Delivery and Delivery Times
5.1 Delivery is made to the delivery address specified by the customer.
5.2 The delivery time may vary and cannot be directly influenced by GastroAir GmbH. A binding delivery time therefore cannot be guaranteed.
6. Right of Withdrawal
6.1 Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period is 14 days from the day on which
- you or a third party named by you, who is not the carrier, has taken possession of the goods.
6.2 Exercising the right of withdrawal
To exercise your right of withdrawal, you must inform us (GastroAir GmbH, Lahnstraße 31-33, 45478 Mülheim an der Ruhr, Germany, email: info(at)gastroair.de) of your decision by means of a clear statement (e.g. a letter or email).
You may use the enclosed model withdrawal form, although this is not mandatory.
6.3 Consequences of withdrawal
If you withdraw from this contract, we will refund all payments received from you, including delivery costs (with the exception of additional costs resulting from a delivery method other than the standard delivery offered by us). Repayment will be made within 14 days of receipt of the withdrawal notice, at the latest once the goods have been returned to us or you have provided proof that you have returned the goods.
The customer bears the cost of returning the goods.
6.4 Exclusion of the right of withdrawal
The right of withdrawal does not apply to:
- Goods that are made to customer specifications or are clearly tailored to personal needs.
- Sealed goods that are not suitable for return for reasons of hygiene protection if their seal has been removed after delivery.
- Goods that are perishable quickly or whose expiry date would be quickly exceeded.

7. Warranty
7.1 The statutory warranty rights apply.
7.2 Complaints may be sent to the address given in the withdrawal notice.
8. Liability
8.1 GastroAir GmbH is only liable for damages resulting from gross negligence or intent.
8.2 Liability for damage to life, body or health as well as under the Product Liability Act remains unaffected.
8.3 No liability is accepted for damage caused by improper handling or natural wear and tear.
9. Data Protection
The collection and processing of personal data is carried out in accordance with the statutory data protection provisions. The privacy policy is available in the shop.
10. Final Provisions
10.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
10.2 Should individual provisions of these T&Cs be or become invalid, the validity of the remaining provisions shall remain unaffected.
10.3 The place of jurisdiction for all disputes arising from or in connection with this contract is the registered office of GastroAir GmbH, provided the customer is a merchant, a legal entity under public law or a special fund under public law.
